Section I Statement of Purpose and Disclaimer
a. The following is a compilation of all pertinent information that may be required by an agent of the FCC while inspecting
or presenting a query to EveningStormTM Radio Studios. It may also be of interest to those who may be in the process of
developing a Part 15 broadcast station. Please note that under any circumstances are the following parts of information to
be taken as receiving legal advice from EveningStormTM Radio Studios, it's agents, associates, or anyone associated directly
or indirectly with EveningStormTM Radio.
1. No liability is assumed for any information that is broadcast over the air, either online or over the AM
frequency. EveningStormTM Radio believes in the right to free speech under the Constitution. It is the listeners responsibility to
choose when to turn the dial when the content does not agree with his
or her views. This station is geared towards an audience of of ages 18 and up. Please see Section II below for further
information related to this section.
b. In addition to broadcasting on the internet, EveningStormTM Radio Studios/Eveningstormradio.com operates on the AM frequency under FCC Part 15 rules and regulations (Sec. 15.219 Operation in the band 510-1705 kHz.) and intends to fully comply with the same. While the right to free speech is important, EveningStormTM Radio is not a "Pirate Radio station" and does not hide the location and/or the band on which it operates. All program schedules are publicly posted on the website and announced over the air waves. EveningStormTM Radio is self-funded and relies solely on the sales of it's album (ISBN 0-9672423-2-0) and promotional items, as well as the income of EveningStorm Studio to fund it's activities. Advertising fees will be charged according to fluctuating rates assigned by EveningStorm Radio.
c. 1610 AM EveningStormTM Radio is a private community oriented radio station. It's mission is to give the listening area an air wave voice of it's own. Local businesses, civic groups, etc. are encouraged to request ad space for broadcast.
Section II Content
a. The majority of broadcasts incorporate talk radio, old time radio re-broadcasts, music mixes created by EveningStormTM Radio Studios, and comedy. While this station is geared towards adults over the age of 18, the content is censored as to comply with proper on-the-air etiquette. The DJs/guests/music aired on EveningStormTM Radio will not and do not make any statements that are racial, sexual, or anti-American in any way. Advertisers who seek to promote such services or products on the air will not be allowed to advertise on EveningStormTM Radio.
b. The primary program aired on EveningStormTM Radio is a morning show titled, "The Morning Rush with VC and Ned." This program airs every morning for varying lengths of time. Most all morning shows are pre-recorded. After hours, the show occasionally replays prior episodes for listeners who missed the primary broadcast. However, old time radio shows are often played at various times throughout the week or weekend.
c. Music from the 70's, 80's, and 90's is broadcast over the airwaves only. EveningStorm Radio had previously made contact with BMI® (2004) in regards to licensing and was advised that no license was needed due to this station's operating power and FCC licensing requirements. However, due to BMI® licensing changes, EveningStorm Radio is now fully licensed by BMI® to broadcast their artists music on this part 15 station. To request a copy of this license, see the bottom of this page that references the Public Inspection File Request.
d. Public service announcements and commercials are also aired everyday day.
Section III Ownership Profile
a. EveningStormTM Radio/Studios is owned and operated as a sole proprietorship. There are no investors and no investments are solicited in any way. The owner and primary DJ is a 35 year old veteran of the US Army Infantry and 12 year veteran of Law Enforcement/SWAT. Although forced to leave his profession in 2002 due to a disabling condition, he is still a sworn officer on reserve status. The owner is also the author of several books and screenplays, which can be found on all major online bookstores. He is an enrolled member of the Echota Cherokee Tribe of Alabama (roll#28596), one of the largest State Recognized Indian tribes in Alabama.
Section IV Equipment List and Signal Processing
a. EveningStormTM Radio/Studios uses various amount of equipment to create a professional broadcast both online and on the air waves. The radio transmitter that is used is an unaltered AM1000 Rangemaster by Hamilton PCB Design (FCC Certified). The entire transmitter system is set up according to manufacturer instructions as it was certified by the FCC. No modifications have been made to the unit. No linears, or other power boosters are used. Connected to the transmitter is an KLHI Audio Systems CD changer, MXL 990 Condenser microphone, Shure® PG48 vocal microphone, and a Behringer Shark Compressor/Limiter, TC Helicon Voiceprism Plus, and a Behringer Eurorack UB802 6 channel mixer. Powering the system is a Compaq Presario 7360 computer.
1. The antenna is exactly 102 inches in length. The Transmitter is mounted on a wooden base which is in turn mounted on top of a 25 foot grain silo. The total height is approximately 35 feet at the tip of the antenna whip.
b. The online station, whenever actively broadcasting, uses the Radio Destiny Broadcaster software by Destiny Media Technologies (Pirate Radio Network is a trade name and does not reference to an actual pirate radio station) (Destiny Media Player is a trademark of Destiny Software Productions Copyright © 2000 All rights reserved.). All files are pre-recorded and played through their network. Listeners are required to download the media player in order to receive the stereo broadcast. Music is not aired over the internet stream. Streaming times may vary.
c. Most all programs aired on EveningStormTM Radio are pre-recorded. This is done in order to create a better sounding production, and allow for hands free operation of the station when the DJ has to step away from the console. All vocals and effects are processed via software, using up to four different filters per voice to gain the proper sound. Background music is also mixed in with a similar processing procedure. Live programs are also often aired, with all programs being recorded to CD for later playback and archival purposes. EveningStorm radio holds licenses to use all background music/effects that are not created at EveningStorm Studio.

Additional provisions to the general radiated emission limitations. (a) The
regulations in Secs. 15.217 through 15.255 provide alternatives to the general
radiated emission limits for intentional radiators operating in specified
frequency bands. Unless otherwise stated, there are no restrictions as to the
types of operation permitted under these sections. (b) In most cases, unwanted
emissions outside of the frequency bands shown in thes

Section V Hours of Operation
a. EveningStormTM Radio normally broadcasts "The Morning Rush" morning show every day at 0700 hours. The show averages about 1 to 3 hours in length and is replayed over until the morning broadcast ceases, which is usually around Noon or 12:00. On occasion, the morning shows are replayed throughout the day, as mentioned in Section II b. above.
b. EveningStormTM Radio on frequent occasions broadcasts replays of the day's radio program overnight. Therefore, the official operating hours of EveningStormTM Radio can be classified as both Day and Night, with only the original broadcast of the Morning Rush morning show being the only definite scheduled hours of operation. Due to range restrictions at night, the day time broadcast offers the best reception for local listeners.
c. Old Time Radio shows are occasionally played during the daytime and various night time shows, as well as music on the air waves only. No music is aired over the internet unless it is copyright free, or permission has been obtained from the artist. Future licenses that will allow streaming music are being considered at this time.
Section VI Station Frequency and Geographical Location
a. EveningStormTM Radio Studios are located on private property in Southern Cabarrus County, East of Charlotte, North Carolina. On the air and in advertising to non-locals, EveningStormTM Radio identifies with the closest large city, being Charlotte, to give listeners the location of this station broadcast.
b. Our location via longitude/latitude, as determined by GPS is Longitude: W 80 30 2 and Latitude: N 35 13 38.
c. EveningStormTM Radio broadcasts on AM 1610 EveningStormTM Radio acknowledges that if any interference is reported by a third party and/or the FCC, the broadcast will cease until a clear channel can be found. As of 28 Feb. 2003, the current equipment configuration is considered in compliance with the rules, in good faith, to the best of our engineering capabilities.
Section VII Pre-Operation Testing and Surveying
a. Prior to operating the AM frequency portion of this radio broadcast, a number of internal/external surveys and tests were performed by the owner. This was to insure a clear signal, which would not impose on the rights of both licensed commercial stations and listeners of the same. Section b. describes this process in detail.
b. First, a general listing of North Carolina AM radio stations closest to the chosen operating frequency (1610) were compiled to the best of the owner's ability. Those stations which are within approximately 60 kilometer radius are as follows: (Please note that there may be others completely unknown to us, which help would be appreciated in keeping it current) Please note that not all details of each station have been shown. Most operate on both day and night hours.

In addition to the location of known stations, it was also necessary to determine which frequencies
could actually be received in the geographical area of the EveningStormTM Radio Studios. Therefore, the best test
equipment available was a sensitive car radio which was taken out within a one mile perimeter of the
EveningStormTM Radio Studios. If a frequency was clear at one mile out, then in good faith, it could be assumed
that it would not interfere with the broadcasts of other stations. This test was performed during both day and night
time broadcast hours. Also, spot checks were performed from the outer perimeter of mile inward to the studio.
In addition to radio station interference, television reception was also taken into consideration. Although most
individuals within the studio area are cable subscribers, all channels were clear, including local stations and paid
access channels. Different individuals and various distances were queried as to report any interference with normal
operation of any radio/television devices. None reported any problems or bleed through.
After going on the air, a recorded test and announcement message was played over the air for two days at various
intervals. The message gave out contact information and instructed anyone who was received any type of
interference, to contact this office immediately. No reports were filed.
c. After conducting the basic initial research as listed above, no complaints have been noted, as well as no interference
has been found by EveningStormTM Radio Studios.
Section VIII Periodic Testing
a. Periodic testing of the broadcast in conducted and documented at regular intervals. This testing includes many
items such as listed in Section VII b. above.
b. Station Documentation/Logs
1. This station keeps a log of On-Air hours of operation for the AM broadcast. Also, Inspection logs are kept documenting when equipment is inspected for proper operation. Monitoring of the actual radio broadcast via a separate radio is also included in the inspection.

Subpart C_Intentional Radiators
Sec. 15.219 Operation in the band 510-1705 kHz.
(a) The total input power to the final radio frequency stage
(exclusive of filament or heater power) shall not exceed 100 milliwatts.
(b) The total length of the transmission line, antenna and ground
lead (if used) shall not exceed 3 meters.
(c) All emissions below 510 kHz or above 1705 kHz shall be
attenuated at least 20 dB below the level of the unmodulated carrier.
Determination of compliance with the 20 dB attenuation specification may
be based on measurements at the intentional radiator's antenna output
terminal unless the intentional radiator uses a permanently attached
antenna, in which case compliance shall be deomonstrated by measuring
the radiated emissions.

b. To conform to applicable provisions of Part 15 of FCC Rules, operation is subject to the following two conditions:
1. This device may not cause harmful interference, and
2. This device must accept any interference received, including interference that may cause undesired operation.
Section X Transmission/Listener Area
a. For an approximate listening area, please see the map located here. Geographically, the listening area covers the southeastern most corner of Cabarrus County and into Stanley County, North Carolina. The EveningStormTM Radio Studio is located at an intersection of several small towns. The closest cities and towns to the studios are Charlotte(10 miles west), Midland(0 miles), Stanfield(.1 miles), Locust(1 miles), and Albemarle(15 miles east). This
coverage is approximate and can change without notice due to conditions or soil conductivity.
Section XI Community Service
a. The EveningStormTM Radio Studio, in addition to AM transmission capabilities, is also equipped with GMRS/FRS/CB radio equipment. The owner of the station is a sworn law enforcement officer and an individually licensed GMRS radio operator. An amateur radio license is in the works also. During a time of emergency or disaster, EveningStormTM Radio Studios is available to assist with communications should there be a need in the local area. The mobile broadcasting unit (MBU) is a self contained power and communications unit, capable of being transported to any location with a mobile 100 mW AM transmitter.
b. Emergency Alert System - On March 29, 2005, EveningStorm Radio installed and put on the air, an Emergency Alert System. This system, designed and built by EveningStorm, rebroadcasts the NOAA All Hazards Weather Alerts as they arise. The system receives the alerts via S.A.M.E. technology and is set to receive alerts based on the FIPS codes for Cabarrus, Mecklenburg, Stanly, and Union county areas. Whenever a test or actual alert is issued, the EveningStorm regular broadcast is interrupted and the alert will begin broadcasting. A voice alert will advise the emergency message for 5 minutes, then revert back to the regular broadcast unless the alert is extended via the proper authorities. EveningStorm radio felt that many local listeners who do not have access to a NOAA radio would benefit should a message be broadcast. Alerts include, but are not limited to, emergency messages, severe weather warnings and AMBER alerts.
Section XII Complaints
a. As of March 2005, no complaints have been filed by the public or the FCC to the best of this stations knowledge. To file a complaint of interferrence or any other matter of concern, see the section below.
